Terms of Service

Important: Physy is a planning and logging tool, not medical care. Exercise involves risk. Use your judgment, follow qualified professional advice, and stop if you experience pain, dizziness, or other concerning symptoms.

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the Physy mobile application, website, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 13 years old and legally able to enter into these Terms. If the law where you live requires a higher age, that higher age applies. You must provide an accurate name and a valid email address and keep that information current. You are responsible for protecting access to your email account, devices, and Physy account and for activity under your account.

3. Health and safety disclaimer

Physy does not provide medical advice, diagnosis, treatment, rehabilitation, or emergency services. Workout plans, timers, cues, records, examples, and other content are for general informational and organizational purposes only. They are not a substitute for advice from a physician, physical therapist, certified trainer, or other qualified professional who understands your individual health.

Exercise can cause serious injury, disability, or death. Before beginning or changing an exercise program, consider consulting a qualified healthcare professional, particularly if you have a medical condition, injury, are pregnant, take medication, or have been inactive. You assume responsibility for selecting suitable activities, equipment, intensity, environment, and supervision. Stop exercising and seek appropriate help if you experience concerning symptoms.

4. License and acceptable use

Subject to these Terms, Physy grants you a limited, personal, nonexclusive, nontransferable, revocable license to use the Services. You may not misuse the Services; interfere with their security or operation; access another person’s account; upload malicious code; reverse engineer the Services except where law expressly permits; use automated means to overload or extract from the Services; or use the Services in violation of law or another person’s rights.

5. Your content and data

You retain your rights in information you enter into Physy. You grant us a limited license to host, process, transmit, and back up that information only as needed to provide, secure, maintain, and improve the Services and as described in the Privacy Policy. You are responsible for maintaining any backups you require.

6. Communications

We may send essential transactional messages about authentication, account security, service changes, or these Terms. Marketing messages are separate and optional. If you opt in to marketing, you may unsubscribe at any time without losing access to the Services.

7. Testing services and changes

Physy may be offered through private, internal, beta, or other testing programs. Testing versions may contain errors, change without notice, or experience downtime or data loss. We may add, remove, suspend, or modify features and may stop offering some or all of the Services. We will provide notice when reasonably required.

8. Third-party services

The Services may interact with third-party platforms such as Google Play, Google Drive, Dropbox, and cloud or email providers. Their services are governed by their own terms and policies. Physy is not responsible for third-party services outside our control.

9. Termination and deletion

You may stop using Physy at any time and may request account deletion through the app or our account deletion page. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the Services. Provisions that by their nature should survive termination will survive.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, quiet enjoyment, and noninfringement. We do not promise that the Services will be uninterrupted, error-free, or suitable for your individual fitness or health needs.

11. Limitation of liability

To the maximum extent permitted by law, Physy and its owners, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities, arising from or relating to the Services. Our aggregate liability for all claims relating to the Services will not exceed the greater of US $100 or the amount you paid Physy in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, excluding conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts with jurisdiction in New Mexico, unless applicable consumer law gives you the right to use another forum.

13. General terms

These Terms and the Privacy Policy are the entire agreement regarding the Services. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a reorganization, financing, merger, acquisition, or sale of assets.

14. Changes

We may update these Terms. We will post the revised version with a new effective date and provide additional notice when required. Continued use after the effective date means you accept the updated Terms.
